Terms & Conditions
The terms for using a form builder somebody self-hosts: your account, your content, what is allowed, and what the operator does and does not promise.
These are the terms between you and the operator of this install of Tinyform. By creating an account or filling in a form served from it you agree to them.
The parties
The operator is [name, legal form, address, contact], who runs this copy of the software on their own server. You are either an account holder, who builds and publishes forms, or a respondent, who fills one in. The people who write the software are not a party to these terms and provide no service to you.
The software and the service
Tinyform is open-source software, licensed under its own licence, which governs the code. What the operator provides is a running instance of it: an address to sign in at, storage for your forms and their answers, and the emails the product sends. These terms cover that instance. Anyone may install their own copy elsewhere, and those copies are not the operator's.
Your account
- Give accurate details and keep them current.
- Keep your password to yourself. Two-factor authentication is available and you are encouraged to turn it on.
- You are responsible for what happens under your account, including what the members you invite into your workspaces do there.
- One person, one account, unless the operator agrees otherwise.
Your content
You keep every right to the forms you build and to the answers they collect. You grant the operator only what is needed to store, serve and deliver that content to you, your workspace and your respondents.
You are the controller of the personal data your forms collect. That means you decide what to ask, you need a lawful basis for asking it, and you owe your respondents a privacy notice of your own. The operator processes those answers on your behalf under the Data Processing Agreement.
What is not allowed
Do not use this install to:
- collect passwords, card numbers or other secrets through a plain question, or impersonate another person or organisation to obtain anything;
- distribute malware, run phishing, or send unsolicited mail from a form's notifications;
- publish content that is unlawful, that harasses or threatens someone, or that sexualises minors;
- publish content you have no right to publish;
- probe, overload or interfere with the server, or bypass an access rule or a limit;
- submit false reports about other people's forms.

Limits and plans
Every install has fair-use allowances, published with their live numbers at Fair use. A limit never costs you a respondent's answer: a submission is not discarded because an allowance was passed.
Where the operator sells a paid plan, The Pro plan says what it adds, Billing and payment info how it is charged, and Refund policy how a charge is reversed. On an install with no payment processor configured there is no paid plan and nothing here is charged.
Availability and support
The operator runs the service on a best-effort basis and may take it down for maintenance, updates or repair. They promise no particular uptime unless they state one here: [service level, if any]. Support is reached through Support, which says whether this deployment has a support address and what to include.
Ending the agreement
You may delete your account at any time from your account settings. A form you delete stays thirty days in the trash and is then removed; deleting your account removes your data on the schedule in the Privacy notice.
The operator may suspend or close an account that breaks these terms, and may close a form or remove content that does. Where practical they will tell you first.
Liability and warranties
The service is provided as it is. The operator does not warrant that it is free of errors or interruptions. To the extent the law allows, the operator is not liable for indirect losses, lost data you could have exported, or content published by other users. Nothing here limits liability that cannot be limited by law. The software's own licence disclaims warranties on the code itself.
You agree to hold the operator harmless from claims arising from the forms you publish and the data you collect.
Changes
The operator may change these terms. A material change will be announced before it takes effect, and continuing to use the service after that date is acceptance. The date of the last change: [date].
Governing law
These terms are governed by the law of [jurisdiction], and disputes go to the courts of [place], without prejudice to rights a consumer has under their own local law.
